In fulfilment of the information obligation under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter: ‘GDPR’, we hereby inform you that we process your personal data:

I. The administrator of your personal data is Smart Solutions HR Sp. z o.o. in Katowice (hereinafter: “Administrator”).

III. We indicate below the purposes and the legal basis for processing your personal data:

1. for recruitment and marketing purposes including the provision of commercial information (legal basis: Article 6(1)(a) GDPR)
2. for the purposes of taking action prior to the conclusion of a contract and subsequently for the performance of the contract (legal basis: Article 6(1)(b) of the GDPR)
3. in order to comply with the Administrator’s legal obligations under applicable legislation (legal basis: Article 6(1)(c) GDPR)

4. to the extent and for the purpose for which you have given your separate consent (legal basis: Article 6(1)(a) GDPR)
5. for the possible establishment, investigation or defence against claims, which is our legitimate interest (legal basis: Article 6(1)(f) GDPR)
6. for the purpose of evaluating the services provided, satisfaction surveys, which is our legitimate interest (legal basis: Article 6(1)(f) GDPR)

7. for archival (evidential) purposes in order to safeguard information and data in the event of a need to prove the facts, which is a legitimate interest (legal basis: Article 6(1)(f) GDPR)
8. for direct marketing purposes, which is our legitimate interest (legal basis: Article 6(1)(f) GDPR)
9. the conclusion or performance of a contract to which you are a party (legal basis: Article 6(1)(b) GDPR);
10. processing for the purposes of legitimate interests pursued by the Administrator or by a third party, inter alia to ensure the security of the service, to make statistical measurements, as well as to carry out marketing and promotion of the Administrator’s own services (Article 6(1)(f) GDPR).

IV. You may withdraw your consent to the processing of your personal data at any time by directing your request to the e-mail address privacy@smartsolutions-hr.pl . The withdrawal of consent shall not affect the lawfulness of the processing of personal data prior to its withdrawal.

V. Your personal data will be processed for the period for which we or another processor has one of the legal bases under the RODO, and after that period for the period required by applicable law, and in the case of the legitimate interests of the Controller for the duration of their implementation. In relation to data for which you have given your consent, until you revoke it.
VI. Your personal data may be disclosed to:

1. entities whose services the Administrator uses for the operation of IT systems, as well as entities providing technical services to the Administrator.
VII. We generally only share your personal data with our contractors to the extent necessary for the provision of services, technical and customer support, but we may also require the transfer of data to other parties.
VIII. We process your data such as your name, contact details email, telephone. We will share your data with affiliated companies and entities cooperating with Smart Solutions HR SP. z o.o. You have the right of access to your personal data and the right to request their rectification, erasure, portability, objection or restriction of their processing, insofar as this will not be contrary to the provisions of the law.in the GDPR (Articles 15-22 GDPR).

IX. You have the right to object to the processing of your data for direct marketing purposes, as well as on the grounds of your particular situation (which must be indicated in such a situation) in the case of data processing by the Controller on the basis of Article 6(1)(f) of the GDPR, i.e. processing by the Controller for the purposes of legitimate interests.
X. You also have the right to lodge a complaint to a supervisory authority (the President of the Office for Personal Data Protection or any other competent supervisory authority) if you consider that the processing of your personal data violates the provisions of the GDPR.
XI. The provision of data is voluntary, but the consequence of failing to provide personal data will be the inability to participate in the recruitment process and to receive commercial information.
